Terms and Conditions of Membership with Extra Extra Ltd
1. Introduction
a) Extra Extra Ltd, a company operating as an employment agency under Made Mage Films Ltd and duly registered under the laws of Ireland (hereinafter referred to as "Extra Extra"), provides services primarily within the film, television, and advertising industries. Extra Extra facilitates opportunities for its members by connecting them with third-party hirers (including but not limited to production companies) and clients (including but not limited to casting agents and casting directors).
2. Engagement with Clients and Hirers
b) All clients and hirers seeking to engage with Extra Extra are required to enter into a formal contractual agreement with Extra Extra prior to being granted access to its database of members. Extra Extra may disclose relevant personal data to verified clients and hirers solely for the purpose of facilitating potential work opportunities for its members, in accordance with applicable data protection laws.
c) In circumstances where a work opportunity is secured through a client of Extra Extra, all associated payments from the hirer shall be collected by Extra Extra on behalf of the member. This is to ensure timely and efficient processing through Extra Extra’s designated payment system.
3. Authority
d) This Agreement constitutes a legally binding contract between the individual subscribing to Extra Extra’s services (hereinafter referred to as the "Member") and Extra Extra. By subscribing to and utilising the services provided by Extra Extra, the Member expressly agrees to be bound by the terms and conditions contained herein.
e) The Member hereby grants Extra Extra full authority to enter into contracts with hirers on the Member’s behalf, in relation to any work opportunity secured through Extra Extra.
4. Right to Work
f) The Member confirms that they possess the legal right to work in the Republic of Ireland, either through citizenship or appropriate immigration status. The Member agrees to notify Extra Extra without delay of any changes to their legal right to work, including but not limited to visa status, residency rights, or employment eligibility.
5. Use of Photographs
g) The Member may upload personal photographs to the Extra Extra platform for casting purposes. By submitting such photographs, the Member grants Extra Extra a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute the images in any media, solely for the purpose of securing work opportunities. This licence shall remain in effect until the photographs are removed from the platform.
The Member warrants that any photograph uploaded is either their own original work or that they have secured the necessary copyright permissions from the rights holder. The Member agrees to indemnify and hold harmless Extra Extra against any claims arising from the unauthorised use of photographs. Extra Extra reserves the right to remove or reject any images that are, in its sole discretion, of poor quality, inappropriate, infringing, or otherwise unsuitable for casting purposes.
The Member agrees to ensure that their profile photograph remains current and accurately reflects their present appearance. For Members under the age of twelve (12), a parent or legal guardian must maintain the accuracy and currency of such photographs.
h) During the registration process and at other times, Extra Extra may arrange for professional photographs to be taken of the Member for casting purposes ("Casting Photos"). The Member grants Extra Extra the perpetual, worldwide right to use, reproduce, and distribute the Casting Photos for the purpose of promoting the Member, securing work opportunities, and marketing Extra Extra’s services in any form of media. The Member acknowledges and agrees that they shall not have any rights to use the Casting Photos independently or for any other purpose not authorised by Extra Extra.
6. Professional Conduct
i) The Member is expected to uphold a professional standard of conduct at all times. This applies to their interactions with Extra Extra, our clients, hirers, and while on set. Professionalism includes promptly responding to availability checks, demonstrating reliability and respect, and following on-set directions. Any failure to meet these standards—such as tardiness or not showing up for scheduled work—may lead to termination of their membership at the sole discretion of Extra Extra.
j) In the event that complaints are received concerning the Member’s conduct or performance—including, but not limited to, tardiness, failure to attend assignments, or other forms of misconduct—Extra Extra reserves the right, at its sole discretion, to remove the Member from its database. Such removal shall be final, and no refunds or reimbursements of any fees previously paid shall be issued.
k) Furthermore, when engaged for a work assignment, the Member agrees to remain available for the entirety of the scheduled workday. The Member acknowledges that production schedules may require early start times and/or extended hours, and agrees to accommodate such scheduling as a condition of the engagement.
7. Payment Terms and Commission
l) The applicable rate of pay for each assignment, along with any relevant union agreements or conditions, shall be specified in the availability check communicated to the Member. Should the Member not agree to the specified terms or rate of pay, they retain the right to decline the opportunity. However, once a Member has been confirmed or provisionally booked (penciled in) for an assignment, they may not request to be released from the booking solely on the basis of the rate of pay.
m) Extra Extra shall be entitled to deduct a commission fee from the Member’s gross earnings for each successful engagement arranged through its services. The standard commission rate shall range between twelve percent (12%) and twenty percent (20%), unless otherwise specified by Extra Extra for a particular assignment. Extra Extra will provide prior notification to the Member of any variation in commission rates before confirming the Member’s booking for the relevant assignment.
The annual membership fee for adult Members is €30 (thirty euro), payable on the first day of work or once per twelve (12) month term. This fee shall not be deducted without the Member’s prior consent. Membership for individuals under the age of eighteen (18) is offered free of charge and is not subject to the membership fee.
8. Amendments to Fees
n) Extra Extra reserves the right to amend its membership fees and/or commission rates at its sole discretion. Any such modifications shall be published on the official Extra Extra website and shall take effect immediately upon posting. Continued use of the platform and services after such changes constitutes acceptance of the amended terms.
9. Payment Authority and Processing
o) The Member hereby grants Extra Extra exclusive authority to receive payment on their behalf for any and all work assignments secured through Extra Extra. Extra Extra shall invoice the respective hirers on a weekly basis. Payments are generally received between four (4) and twelve (12) weeks following the completion of the relevant assignment. Status updates regarding outstanding payments shall not be provided until a minimum of eight (8) weeks has elapsed from the date of the assignment. In certain cases, payment may be made directly by the production company; the Member will be notified in advance should this arrangement apply.
p) Extra Extra processes all payments on a weekly payroll cycle and disburses funds via electronic bank transfer to the Member’s nominated bank account. Due to the timing of hirer remittances and payroll processing, it may take up to ten (10) business days or more for payments to be received. It is the sole responsibility of the Member to ensure that accurate and up-to-date banking information is maintained within Extra Extra’s system. Extra Extra shall not be held liable for payment delays arising from incorrect or incomplete banking details.
q) For each payment issued, Extra Extra shall provide the Member with a remittance advice detailing gross earnings and any deductions made for tax, commission, and/or administrative fees.
10. Health and Safety
r) In accordance with the Health and Safety in the Workplace Act 2005, the responsibility for maintaining a safe and compliant work environment lies with the hirer, typically the production company. The Member agrees to indemnify and hold Extra Extra harmless from any and all claims, liabilities, costs, or damages arising from their engagement with any third-party hirer.
s) Extra Extra accepts no liability for any injury, loss, or harm sustained by the Member while commuting to or from an assignment or while working on any assignment arranged through Extra Extra.
t) The hirer is responsible for informing the Member of any relevant health and safety risks and for ensuring that a safe working environment is provided. The Member agrees to take reasonable care for their own health and safety and to cooperate fully with any health and safety measures implemented by the hirer. Any unsafe practices or conditions observed by the Member must be promptly reported to Extra Extra.
11. Data Protection and Privacy
u) Extra Extra processes all personal data in accordance with the Data Protection Act 2018 and other applicable Irish data protection legislation. Personal data is stored securely and may be shared with verified clients and hirers solely for the purpose of facilitating employment opportunities. Sensitive personal data will be disclosed only where necessary and on a need-to-know basis. Bank account details shall not be shared without the Member’s prior consent.
v) The Member’s personal information will be retained by Extra Extra for the duration of their membership and may be removed upon written request submitted by the Member via email.
12. Provisions Concerning Minors
w) For Members under the age of eighteen (18), a signed Parental Consent Form must be submitted prior to being considered for any assignments. The parent or legal guardian expressly authorises Extra Extra to enter into binding agreements on behalf of the minor and further grants Extra Extra the right to appoint a designated chaperone or crew member to sign documentation relating to the production, where necessary.
13. Termination of Membership
x) The Member may terminate their membership with Extra Extra by providing written notice following the completion of all outstanding work commitments. Extra Extra reserves the right to terminate a Member’s registration at its sole discretion by providing two (2) weeks’ notice, or immediately in the event of a material breach of these Terms and Conditions.
14. Limitation of Liability
y) This Agreement constitutes the entire understanding between the Member and Extra Extra. Should any provision of this Agreement be deemed invalid, illegal, or unenforceable, such provision shall be severed and the remaining provisions shall remain in full force and effect. Extra Extra shall not be held liable for any delays, failure in performance, or interruptions of service resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of war, civil unrest, or labour disputes.
15. Amendments to Terms
z) Extra Extra reserves the right to modify or amend these Terms and Conditions at any time. Such modifications shall become effective immediately upon publication on the official Extra Extra website. Should the Member not accept the revised Terms and Conditions, they must notify Extra Extra in writing prior to the effective date, upon which their membership will be terminated following the completion of any outstanding commitments.
16. Privacy Policy
Extra Extra is committed to compliance with applicable data protection legislation and to safeguarding the privacy of its Members. All personal data provided by the Member shall be processed exclusively for the purpose of facilitating work-related bookings. No personal data shall be shared without the Member’s consent, except where required for the execution of booking procedures. The Member is solely responsible for ensuring that all personal information provided to Extra Extra remains accurate and current.
